McDonough Case Moving To Trial

(CENTREVILLE) – The case against St. Joseph County Prosecutor John McDonough is moving on to trial.

St. Joseph County District Court officials say an online pretrial conference was held Friday afternoon. Kalamazoo County District Court Judge Vincent Westra, who was asked to preside over the conference, said the case will move forward once the State of Michigan allows the courts to conduct this type of legal proceeding.

When that will be is not known. Currently, St. Joseph County is in Phase 2, based on certain requirements that the Michigan Supreme Court has instituted to allow for courts around the state to open and conduct business. To be able to hold a trial, Westra says St. Joseph County must be in Phase 3.

During the proceedings, Westra set a personal recognizance bond of $500 and made sure McDonough understood the conditions that were established in his waiver arraignment. Those conditions include McDonough to not possess, purchase or consume intoxicants; not to patronize a retailer whose primary business is selling alcohol and not to use or possess illicit controlled substances.

McDonough has been charged with drunken driving and having open intoxicants in a motor vehicle by the Michigan Attorney General's Office. The charges stem from an incident May 11 in Lockport Township. The St. Joseph County Sheriff's Department was called to the 17,000 block of Lovers Lane just after 7 PM. Deputies found a black SUV parked on the north side of the road, facing east. McDonough was the lone occupant of the SUV. There was damage to the vehicle and a nearby fence.

Operating under the influence is a 93 day misdemeanor charge while the open intoxicant charge is a 90 day misdemeanor.
