(CENTREVILLE) – A motion hearing for a Sturgis man is being continued.

St. Joseph County Circuit Court personnel say the case against 35 year old Wade Allen has been pushed back again to allow for Circuit Court Judge Paul Stutesman to go over the transcripts from two other hearings related to this matter.

Allen was arrested May 22, 2019 in the 200 block of North Maple Street after Sturgis Police received an anonymous tip that he was keeping the body of a woman in his apartment. Officers made contact with Allen and were given consent to search the residence.

The St. Joseph County Major Crimes Task Force was activated and executed a search warrant. They found body parts in the freezer, which were identified as 42 year old Kelly Jien Warner-Miller, who had been Allen's girlfriend. He is charged with open murder, dismemberment of a corpse and failure to report a death.

Being questioned is whether Sturgis Police used proper constitutional procedure during a search of Allen's apartment and whether evidence may have been seized legally.
