Smith Questions Opting In Now On Medical Marijuana Licensing Act

(STURGIS) – Under a new act, Michigan communities have the choice to allow medical marijuana businesses to operate in their communities or not.

However, Sturgis' top cop has his reservations about the City opting in at this point in time.

City Commissioners held a work session Wednesday to discuss the Medical Marijuana Licensing Facilities Act that was passed in September 2016. The Michigan Department of Licensing And Regulatory Affairs has created a licensing board, which came up with the five businesses that will be allowed. They are a grower, processor, secure transporter, provisioning center and safety compliance facility.

As City Attorney Roger Bird explains, if a community opts in, they will be able to control how many of these businesses will be allowed, where they can operate and any licensing fees. If a community decides to do nothing, or opt out, then these businesses would not be allowed in their boundaries.

LARA is also working on a licensing system, similar to what the Liquor Control Commission uses.

Smith says he spoke with LARA officials and they told him that they may have the administrative rules ready by December, but were not sure.

He says with out the administrative rules, it could be difficult for local authorities. ...... {LISTEN}.

City Commissioners will do more research and bring the matter back during a future meeting and decide what they will do.
