(KENDALLVILLE) – The man arrested in connection with a shooting incident in Kendallville has waived his extradition back to the Hoosier State.

Noble County authorities says 24 year old Matthew Rodriguez was in an Ohio Court on Thursday and said he would not fight the extradition motion to return to Indiana. Rodriguez is charged with one count of murder for the shooting death of Justin Smead and two counts of attempted murder for the shootings of Alyssa Jeffries and Blake Lewis.

According to an affidavit of probable cause filed in Noble County, Rodriguez opened fire just before midnight on June 27 at the Gallops Gas Station in Kendallville, striking and killing Smead and wounding both Jeffries and Lewis.

Ohio State Police say they recovered a 9 millimeter hand gun from the vehicle Rodriguez was driving. 9 millimeter shell casings were recovered at the scene of the shooting.

If he is found guilty, Rodriguez could face 45 to 65 years in prison on the murder charge and between 20 and 40 years for the attempted murder charges.
