(INDIANAPOLIS) – A lawsuit has been filed against a LaGrange County car dealership for allegedly rolling back odometers on vehicles they sold.

Indiana Attorney General Todd Rokita filed the lawsuit against Flexible Auto Sales LLC in Shipshewana, which is owned and operated by John Allen. It’s alleged that Flexible Auto Sales rolled back odometers by a combined total of over 3 million miles on at least 42 vehicles sold to customers.

According to the lawsuit, the cars were purchased mainly from various auto auctions, who reported the vehicles’ mileage to vehicle history reporting services. They also provided Flexible Auto Sales with odometer disclosure statements and titles for each vehicle.

The vehicles were sold between June of 2018 and March of 2022.

Rokita says the lawsuit alleges that the odometer tampering violates the Indiana Deceptive Consumer Sales Act, the Indiana Odometer Act, the Federal Odometer Act and the Motor Vehicle Unfair Practices Act.

Rokita says in Indiana, businesses must know they will face serious consequences if they betray the trust of Hoosiers in violation of the law. He says his office will hold them accountable and will make them pay.

The Attorney General says he is seeking injunctive relief, consumer restitution, treble damages, civil penalties, costs and other relief.
