(LANSING) – A Coldwater woman’s conviction and prison sentence will stand.
The Michigan Supreme Court has issued an opinion that denies 24 year old Jayme Lynn LaPoint’s Application For Leave To Appeal. That means she will serve between 25 to 50 years on charges of First Degree Criminal Sexual Conduct.
LaPoint entered into the plea agreement with the Branch County Prosecutor’s Office in 2019, following an investigation that started in July 2018. Authorities say that LaPoint took inappropriate pictures of a 21 month old girl she was babysitting and shared them with her then boyfriend David Bailey. LaPoint also told investigators that she took the child to the house she shared with Bailey and they sexually assaulted the infant multiple times.
Additionally, LaPoint also plead guilty to charges filed by the Michigan Attorney General's Office against her and three other individuals for conspiracy to commit kidnapping and conspiracy to commit first degree criminal sexual conduct. She and the others were arrested following an investigation into a plan to kidnap, rape and kill a child at random.
LaPoint argued that her plea was involuntary because she was induced to enter into the agreement by a promise of concurrent sentences, even though that was not possible.
The Michigan Court of Appeals ruled in December 2021 that the trial court did not abuse its discretion by denying that LaPoint couldn’t withdraw her guilty pleas. The matter was petitioned to the Michigan Supreme Court in February 2022, and the court ruled on it Tuesday.
The Michigan Department of Corrections says LaPoint can not be released before August 2043.
